Dwayne Wade's custody battle continues with IL judge's ruling


While child custody issues can be emotional, and sometimes difficult, it is important that all parties focus on achieving the best interests of the children.

An Illinois judge recently denied Dwayne Wade's request to have the visitation rights of the mother of his children suspended. Wade was then instructed to turn the children over for a visit with his ex-wife. The child custody dispute between the pair has been ongoing since the couple divorced in 2010. Wade was awarded sole custody of the couple's children in 2011. Wade has recently written an essay of sorts, adapted from his book, on fatherhood.

Child custody determinations are based on a number of important factors and can be resolved in a number of different ways. Sometimes the parents are able to reach a child custody agreement on their own or are able to reach an agreement through mediation or the help of a legal professional. Other times, if the parents are unable to agree on a child custody arrangement, the court may intervene. The guiding consideration in child custody determinations is always the best interests of the child.

There are different types of child custody arrangements. Primary physical custody of the child will often be awarded to one parent, with whom the child will live. Legal custody, however, will often be shared between the parents so that each has the right to make decisions related to the child's education, religion and health care. Joint custody is another type of custody arrangement, wherein the child spends equal amounts of time with both parents. Sole custody is also sometimes awarded, often in cases when one parent is deemed unfit.
