NBA star Steve Nash reaches settlement in child custody dispute

NBA fans in Illinois may have known that Steve Nash was involved in a long child custody dispute with his ex-wife. Recently, that child custody dispute ended with a settlement. The couple separated in 2010 and they have three children together. A judge accepted the terms of the settlement and sealed it. The exact terms of the settlement have not been disclosed to the public.

However, reports indicated that Nash did not want his ex-wife to move to California with the children because he did not feel it was a good place to raise the children. Nash also reportedly claimed that child support was the real reason his ex-wife wanted to move to California.

Child custody disputes, like Nash's, can be very complicated matters that take a long time to resolve. There are many different child custody issues to consider. Ultimately though, the decision is based on the best interests of the child. The courts look at the age of the children, who has cared for the children in the past, any special needs of the child and others.

There are many decisions that need to be made in a child custody dispute. Decisions regarding both legal and physical custody must be made. Legal custody refers to the decision making regarding the child's medical needs, education, religion and others. Physical custody refers to the decision making as to where the child will live. A decision about whether the parents will have sole or joint custody must also be made as well. Another issue that arises is visitation or parenting time, which sets the schedule as to when the child will be with each parent.

Many times child custody disputes in Illinois can end with a settlement, as in Nash's case. Mediation and negotiation are useful tools in these disputes. The hope is that through mediation the dispute may end more amicably than with litigation. However, if a settlement is not reached, ultimately a judge will make the decision for the people involved in the dispute. Experienced attorneys understand the issues involved in child custody disputes and may be helpful as one works their way through the dispute.
