Under Illinois law (720 ILCS 5/12-3.2), an individual can be charged with domestic battery if he or she knowingly or without legal justification:

  • causes bodily harm to any family or household member;
  • makes physical contact of an insulting or provoking nature with any family or household member.

Domestic battery is classified by the courts as a Class A misdemeanor, provided that the accused has no prior domestic violence conviction. However, if you have previously been convicted of domestic violence, violating an order of protection, attempted murder, sexual harassment, or any other charges of similar nature under this same Code, domestic battery is classified as a Class 4 felony.
